Saphly is a platform that allows users to publish, share, and access digital content, including e-books and related materials, through our website and related platform features (collectively, the "Services"). Because our Services involve user-generated and creator-submitted content, respect for copyright and other intellectual property rights is essential.

This Copyright Policy ("Policy") forms part of our Terms of Service. It explains how we handle copyright infringement claims, what constitutes infringement and piracy, and the process for submitting reports or counter-notices. By using the Services, you agree to comply with this Policy.

We respect the effort creators put into their work and take copyright and other intellectual property rights seriously. Users may only upload, publish, distribute, or otherwise make content available through the Services if they own the content or have the necessary legal rights, licenses, or permissions to do so.

Uploading or sharing copyrighted material without authorization through the Services is strictly prohibited.

If we receive a sufficiently detailed and substantiated report identifying allegedly infringing content available through the Services, we will review the report and take appropriate action. This may include removing or disabling access to the content.

Copyright generally protects the specific expression of an idea (such as the exact wording of text, chapters, dialogue, scenes, or original illustrations), not the underlying idea, theme, or concept itself.

The following similarities are generally not sufficient on their own to establish copyright infringement:

  • Similar themes, genres, or tropes (e.g., “enemies to lovers,” “magic school”).
  • Similar character archetypes (e.g., “grumpy detective,” “chosen one”).
  • Similar high-level plot concepts (e.g., “a heist goes wrong”).

If you are unsure whether content available through the Services constitutes infringement, you should consider seeking independent legal advice before submitting a report, particularly in complex situations involving adaptations, inspiration, or derivative works.

Piracy includes uploading, distributing, or making available through the Services full copies of books, chapters, PDFs, EPUBs, scans, or links that enable users to download or access copyrighted works without proper authorization.

The Services may not be used to promote, facilitate, or engage in the unauthorized distribution of copyrighted material.

To report alleged copyright infringement occurring through the Services, please contact us at contact@saphly.com and submit a notice that includes:

  • A clear explanation of why the content is allegedly infringing and identification of the specific material being copied.
  • The exact location of the content within the Services (URL(s) to the story, chapter, or page).
  • Your full legal name and email address.
  • A good-faith statement that you believe the use of the material is not authorized by the copyright owner, its agent, or the law, and that the information provided is accurate and complete.

Notices that are incomplete, vague, or unsupported may not be processed. Submitting knowingly false or misleading copyright reports may result in account restrictions or other appropriate action.

If content you made available through the Services has been removed or disabled as a result of a copyright report and you believe this action was taken in error (for example, because you own the content, have permission to use it, or it was misidentified), you may submit a counter-notice through our designated process. A valid counter-notice should include a statement explaining why the content was removed in error, along with any relevant supporting information.

We aim to review copyright reports and counter-notices in a timely, diligent, and objective manner and will restore content where appropriate and consistent with applicable law.

We reserve the right to suspend or terminate accounts of users who repeatedly infringe copyright or who repeatedly submit abusive or bad-faith infringement reports.

Attempts to evade enforcement actions, including creating new accounts to bypass restrictions, may result in additional limitations or permanent account termination.

We may update this Policy periodically, indicating any changes through the "Last Updated" date. Continued use of our Services after changes constitutes your acceptance of the new Policy.

This Policy is governed by the laws of Portugal, without regard to its conflict of law principles. Any legal action or dispute arising from this Policy will be resolved in accordance with these laws and regulations.
